The client is obligated to mark the user-defined contents of his account as his own providing his trademark and/or copyright mark. The client holds HPVerticalLine.com harmless from any claims resulting from the violation of this obligation.
Except if expressly stated herein, use of this website, or any other HPVerticalLine.com material, does not grant you any intellectual property rights in any portion of this website, HPVerticalLine.com software, its coding, or content, and all rights not expressly granted are reserved by HPVerticalLine.com.
The client is liable for any claims resulting from the violation of and not allowed to host any content violating any third party’s rights (i.e. copyright, trademark, privacy rights, personal rights etc.), laws and the code of morals that is caused by the content of his/her profile, his/her email addresses and banners and other files, images or documents.
Especially the client is obligated not to offer any pornographic or explicit content or commercial services that violate the laws of the United States. The customer is not allowed to submit his/her site to search engines or link directories or other pages if this violates the rights of any third party, the law or the code of morality.
The client is not allowed to upload, host, post, or share any illegal files.
HPVerticalLine.com is not obligated to search the client’s account for content mentioned under these terms of service. As soon as HPVerticalLine.com finds such content HPVerticalLine.com has the right to suspend and/or terminate the client’s account and take appropriate legal measures.
HPVerticalLine.com is not obligated to notify the client of account suspension, account terminations, or legal action.
The client is obligated to keep the password(s) that belong to his account and email addresses secret and to inform HPVerticalLine.com immediately if he recognizes that unauthorized third parties know the password(s). If third parties abuse the passwords to use the services of HPVerticalLine.com the client is obligated to compensate HPVerticalLine.com for any usage and damage caused by the third parties.
The client is obligated to maintain backups of his own data.
The client is obligated not to send or ask third parties to send any emails that contain advertisements without the permission of the recipient. This regards especially mass sendings of commercial emails with equal or similar content (spamming). Commercial mass mailings may only be sent to subscribers who did request and confirm to be added to a mailing list.
The client is not allowed to run any chat rooms, bots, daemons or IRC tools on HPVerticalLine.com.
If the client fails to abide by these rules the client is liable to pay a contractual penalty of $10,000 (in words: ten thousand dollars) for each breach without referring to the principles of continued act.
The legal venue for any claims resulting from this contract is the United States if the law of the United States does not determine something else. For all contracts that are based on these terms of service the law of the United States is in exclusive force.
If any part of these terms of service are invalid or get invalid this does not cause the other parts of these terms of service to get invalid, too. Instead the invalid rule is to be replaced by a similar rule that the parties would have chosen if they had known that the rule is invalid and that would have caused an equal or similar result. This does also apply if parts of these terms of services are incomplete
Use of HPVerticalLine.com constitutes your agreement to and binds you to all of the terms listed and/or unlisted herein.
